3. Website Access
When you use our services, we automatically set strictly necessary cookies and collect and process the following information to enable the usability of the provided functions and ensure the security and stability of our services:
Processing your IP address is strictly necessary to deliver our services to your device and to measure the performance and technical performance of our services. The legal basis for data processing is Article 6(1)(b) of the GDPR.
Furthermore, our servers store your IP address for up to 14 days for the purpose and interest of ensuring the security of our services (Article 6(1)(f) of the GDPR). We also process your truncated IP address for the purpose and interest of preventing the delivery of harmful programs through displayed advertisements. The legal basis for this is Article 6(1)(f) of the GDPR. Your IP address or pseudonymous ID is automatically anonymized immediately after the respective session is closed. The legal basis for data processing is Article 6(1)(f) of the GDPR.
4. Location of Processing
We also process personal data in countries outside the European Economic Area ("EEA"), including the United States. If there is no adequacy decision by the European Commission for the respective third country, we have concluded standard contractual clauses of the EU Commission in accordance with Article 46(2)(c) of the GDPR with the services used in third countries:
5. Data Retention
We only process personal data for as long as necessary for the purpose mentioned in this privacy policy. Personal data is then deleted unless statutory retention periods oppose such deletion.
II. Your Rights as a Data Subject
1. Information, Correction, Deletion, Restriction, and Right to be Forgotten
You can receive information from us at any time, free of charge, as to whether personal data concerning you is being processed by us, and if so, specifically which data is stored about you, and you can request a copy of the stored data. You can also have incorrect data corrected and completed.
You can also request the deletion and restriction of the processing of your personal data.
2. Data Portability
If applicable, you also have the right to have the personal data concerning you transmitted to you or another controller in a structured, commonly used, and machine-readable format, provided that the processing is based on consent or a contract and is carried out by automated means. However, this does not apply if the processing is not necessary for the performance of a task carried out in the public interest or in the exercise of official authority assigned to the controller. You also have the right to have your personal data transmitted directly from one controller to another, where technically feasible and without adversely affecting the rights and freedoms of others.
3. Withdrawal / Objection
You can withdraw your consent to the storage of your data or the purpose of contact for further surveys at any time with effect for the future at the above-mentioned contact address.
Furthermore, you have the right to object at any time, for reasons arising from your particular situation, to the processing of personal data concerning you, which is carried out on the basis of a legitimate or public interest. In the event of objection, we will no longer process the personal data, unless we can demonstrate compelling legitimate grounds for the processing that override your interests, rights, and freedoms, or the processing serves the establishment, exercise, or defense of legal claims.
4. Right to Lodge a Complaint
You also have the right to lodge a complaint with the competent supervisory authority and the possibility to take legal action. The supervisory authority to which the complaint was submitted will inform you, as the complainant, about the status and results of the complaint, including the possibility of a judicial remedy.
5. Automated Decision-Making
We refrain from automated decision-making or profiling as defined in Article 22 of the GDPR.
III. Cookies and Similar Technologies
1. General
To enable you to use our website and ensure the security of the website, prevent fraud, and rectify errors, as well as to provide technical content on the website, the use of certain cookies and similar technologies is necessary. The use of these cookies is necessary for us to provide the requested service to you. The legal basis is § 25(2) of the German Telemedia Act (TTDSG).
We do not use additional cookies on this website without your prior consent (§ 25(1) TTDSG).
Cookies are small files that the browser stores on your device in a dedicated directory. They can be used, among other things, to determine whether you have visited a website before. Many cookies contain a so-called cookie ID, which is a unique identifier of the cookie. It consists of a string of characters that allows websites and servers to be assigned to the specific internet browser in which the cookie was stored. This enables the visited websites and servers to distinguish the individual browser from other internet browsers that contain other cookies. A specific internet browser can be recognized and identified by the unique cookie ID. Cookies cannot identify you as a person without additional information.
Already set cookies can also be deleted by you at any time using an internet browser or other software programs. This is possible in all common internet browsers. Please note that in this case, you will be asked again how you want to use our website when you visit it again. The duration of the cookies used is limited to a maximum of one year, unless otherwise stated.
We do not use additional cookies on our survey pages without your prior consent.
IV. Miscellaneous
1. Online Surveys
This website is used to conduct online surveys. We use the LimeSurvey GmbH survey tool for this purpose, with which we have concluded a data processing agreement (Article 28 GDPR). We remain responsible for data processing. Participation in the surveys is voluntary, and the legal basis is Article 6(1)(a) of the GDPR. In general, participation does not require the provision of personal data. The survey is intended to analyze usage behavior of Transfermarkt products and identify potentials for the systematic optimization of the user experience with regard to Transfermarkt products. We store the survey questions and answers. In addition, the survey results are evaluated and analyzed by Transfermarkt employees. Your responses (if they contain personal data) will be anonymized or deleted as soon as we have completed the evaluation, unless there are reasons that justify longer retention (for example, if you have given your consent in accordance with Article 6(1)(a) GDPR to be included in the participant database). The documentation and communication of survey results are carried out exclusively in anonymized form, without naming individuals and without providing information that would allow conclusions to be drawn about your person.
2. Participant Database
If you choose to be included in our participant database to receive invitations to further surveys about our products, you must register accordingly. We store the personal data provided by you in accordance with your previously given consent under Article 6(1)(a) of the GDPR. If you no longer wish to be contacted to participate in further surveys or if you wish to have your data deleted from the participant database altogether, you can withdraw your consent at any time with effect for the future by contacting us.
3. Initiating contact
If we contact you, for example, by email, the data you provide (email address, possibly name and phone number) will be processed by us to process your request and, if necessary, to contact you. We will delete the data that arises in this context when it is no longer required for the aforementioned purpose, provided that there are no legal retention obligations that oppose such deletion. The legal basis for data processing is Article 6(1)(f) of the GDPR.
